Trademark Fast-Track – News Rules now in effect

The Brazilian Patent and Trademark Office (INPI) has just published three new ordinances that implement the fast-track examination process for trademark applications. These updates aim to improve efficiency and align trademark prosecution with public policy goals related to innovation and inclusion.

The main regulatory updates are:

INPI Ordinance No. 27, dated July 25, 2025: introduces new free and unlimited fast-track options for: applicants aged 60 or older; individuals with disabilities or serious illnesses; entrepreneurs under the Inova Simples regime. There are no requests limit for this category.

INPI Ordinance No. 28, dated July 25, 2025: regulates the pilot project for requesting fast-track examination based on strategic objectives or public policies, subject to the payment of a specific fee and proof of eligibility. Eligible categories include:

• Opponents claiming prior rights (Art. 129 of the IP Law);
• Applicants needing registration to access public funding;
• Parties involved in court proceedings involving the mark;
• Scientific, Technological and Innovation Institutions (ICTs);
• Products or services tied to fast-tracked patents;
• Projects mentored by INPI;
• Cases declared as public interest or national emergencies by federal act.

INPI Ordinance No. 29, dated July 25, 2025:  sets forth the operational guidelines for submitting fast-track requests under the categories established in Ordinance No. 28. The following framework applies:

• Effective period: August 7 to December 7, 2025.
• Limit of 1,200 requests during the period. Once this threshold is reached, no further requests will be accepted.
• A minimum quota of 100 requests is reserved for each eligible category.
• A maximum of 3 requests per applicant is allowed.
• It is possible to submit a new request with additional supporting documentation to challenge a rejection, provided that quotas are still available.

Requests not granted fast-track status will follow the regular examination procedure, and applicants may submit a new request at a later time. INPI will publish monthly statistics on the number of requests received and processed in each strategic category.
